The Audiencia of Vizcaya dictates that a bank must return the mortgage expenses

In a sentence that was published on July 7, the Provincial Court of Vizcaya ruled that a bank should make the return of all expenses of mortgage settlement, paid by the client, including the Tax Documented Acts (AJD) after estimating the Appeal filed by the same.

The Audiencia and the General Law of Consumers and Users have considered abusive the clause in which it is established that the mortgaged person must pay the taxes of the operation.

In this way, the Provincial Court of Vizcaya requests the return of the AJD plus interest.
